What workplace rights do cancer patients have in Washington?
Cancer patients in Washington have workplace protections under the ADA, FMLA, Washington Law Against Discrimination, and Washington Paid Family and Medical Leave. You are entitled to reasonable accommodations, job-protected leave, and protection from discrimination based on your diagnosis.
Can my employer require me to disclose my cancer diagnosis?
No. You are not required to disclose your cancer diagnosis to your employer. However, to request ADA accommodations or FMLA leave, you may need to provide medical documentation to HR (not your direct supervisor). Your medical information must be kept confidential.
What is Washington Paid Family and Medical Leave?
Washington PFML provides up to 12 weeks of partial wage replacement when you need time off for a serious health condition (including cancer treatment) or to care for a family member. Most Washington workers are covered. Apply at paidleave.wa.gov or call 1-833-717-2273.
Can my insurance deny coverage for cancer treatment?
Insurance companies cannot deny coverage for medically necessary cancer treatment. The Affordable Care Act prohibits denial of coverage for pre-existing conditions. Washington's Office of the Insurance Commissioner (1-800-562-6900) can help if your claim is denied. You have the right to appeal any denial.
What are my rights regarding clinical trial coverage?
Under the Affordable Care Act and Washington State law, insurance must cover routine patient care costs during clinical trials. This includes doctor visits, lab tests, and hospital stays that would be covered outside a trial. The trial sponsor typically covers experimental treatment costs.
How do I file a workplace discrimination complaint in WA?
File a complaint with the Washington State Human Rights Commission (1-800-233-3247) or the federal EEOC. Complaints must typically be filed within 180-300 days of the discriminatory act. Free legal help is available through the Cancer Legal Resource Center and Northwest Justice Project.
